Provider: Luminant Mind e.U., owner Youns Murhidj, Johannagasse 29-35/14/5, 1050 Vienna, Austria, company register no. FN 665878h (Commercial Court of Vienna), email: office@luminantmind.com (hereinafter "Lumeya" or "we")
1. Scope and definitions
1.1 These General Terms and Conditions (Terms) apply to all contracts between Lumeya and customers for the use of the Lumeya platform (app at https://web.lumeya.ai, website creation, hosting and related services).
1.2 Customer means anyone who creates an account. Business customer means a customer for whom the contract forms part of the operation of their business (section 1 Consumer Protection Act, Konsumentenschutzgesetz, KSchG). Consumer means any customer for whom this does not apply.
1.3 Customer site means the website generated and hosted by Lumeya for the customer, accessible at a Lumeya address (https://web.lumeya.ai/s/…) and, optionally, at the customer's own domain, provided that this function has been enabled on the platform.
1.4 Deviating terms of the customer apply only if we expressly agree to them in text form.
2. Registration and conclusion of contract
2.1 Registration is available from the age of 18. During the closed beta phase, registration is possible only with an invitation code. Information provided must be true and up to date. Access credentials must be kept secret; actions taken under the account are attributed to the customer to the extent that the customer is responsible for them.
2.2 Registration creates a free usage contract (an account with access to the customer's own content and data export; during the beta phase, additionally the free beta access under section 4.1). A subscription subject to payment comes into being when the customer clicks the "Subscribe with obligation to pay" button in the order process on the Lumeya order page (section 8 Distance and Off-Premises Contracts Act, Fern- und Auswärtsgeschäfte-Gesetz, FAGG; section 312j German Civil Code, Bürgerliches Gesetzbuch, BGB). Directly above the button we display the essential features of the plan, the total price per billing period (net and including value added tax), the term and the cancellation conditions. The customer enters their payment details on the same page in an embedded form of our payment service provider; there is no further order button afterwards. During the beta phase the button is labelled "Start free beta subscription"; the selected plan is then a free beta subscription (section 4).
2.3 Process and correction of entries (section 9 E-Commerce Act, E-Commerce-Gesetz, ECG): (1) The customer registers with name, email address and password (in the beta phase, additionally with an invitation code) and confirms these Terms and the Data Processing Agreement. (2) For a subscription, the customer selects a plan in the account under "Subscription", states whether they are ordering as a business customer or as a consumer, as a consumer expressly requests that the service begin before the withdrawal period expires, and confirms these Terms. (3) By clicking the button referred to in section 2.2, the customer submits their contractual declaration. Until this click, the customer can review all entries and change them directly in the form, choose a different plan, or cancel the process without consequences by leaving the page. The form indicates missing or invalid entries; no contract is concluded until they have been corrected.
2.4 We confirm the conclusion of a subscription, including a free beta subscription, without delay on a durable medium (email to the account's address) and in doing so transmit the contract content as well as these Terms and, for consumers, the withdrawal information as a text file attachment (section 7 FAGG). We confirm a plan change in the same way, with these Terms attached. If sending fails, we automatically try again. After registration we forward the customer directly to their account; we do not currently send a separate confirmation email for registration. These Terms, the Data Processing Agreement and the Privacy Policy are available at any time for saving and printing.
2.5 Storage of the contract text: Lumeya stores the contract data (plan, price, beta subscription yes or no, order as business customer or consumer, where applicable the request for immediate commencement, time) in the customer's account. At registration, Lumeya also records which version of these Terms, of the Data Processing Agreement and of the Privacy Policy applied at that time, and for each order the version of these Terms, of the withdrawal information and of the Privacy Policy (in each case as a checksum). The customer can see the current plan in the account under "Subscription" and obtains the stored contract data through the data export (section 12). If the customer deletes their account, these contract data are also deleted (section 6.4). The customer receives the Terms in the version valid at the conclusion of the subscription with the confirmation email; the current version is available at Terms of Use.
2.6 The contract language is German.
3. Services of Lumeya
3.1 Website creation: On the basis of the onboarding conversation and the customer's information, Lumeya creates a website from templates. The onboarding assistant and the website texts use a language model from an external provider; the customer’s details go to this provider for that purpose. The rest of the creation runs on Lumeya’s servers.
3.2 Hosting and publication: Lumeya publishes the customer site at the Lumeya address. If the function has been enabled on the platform, the customer can additionally connect their own domain, which they hold themselves with a registrar; Lumeya does not register domains. Server location: Germany (Hetzner Online GmbH).
3.3 Contact form: Enquiries from visitors (name, contact details, message) are stored on the Lumeya server and displayed in the customer's account; by email the customer receives only a notification without the details of the person making the enquiry. Lumeya processes this data as processor on behalf of the customer (see section 11 and the Data Processing Agreement).
3.4 Visitor statistics: When delivering the customer site, Lumeya counts on the server page views per page, by rough origin and by device category (mobile, tablet, computer), as well as enquiries submitted via the contact form, in each case as daily totals. For this purpose the customer site contains no script and sets no cookies; IP addresses and identifiers of individual visitors are not stored for the statistics. Distinct visitors and clicks are not counted (details in the Privacy Policy, section 7).
3.5 Images: The customer can upload their own images; each image is checked in an isolated environment and re-encoded, metadata (including GPS data) is removed, and the original is not stored. If the image generator has been enabled on the platform, Lumeya uses it to generate AI images on its own servers; the generator is designed not to depict people and faces. AI images are labelled as AI-generated (see section 7.6).
3.6 External AI services: For texts and the getting-started conversation and the “Ask Lumeya” chat, Lumeya uses a language model from an external provider; the customer’s details go to this provider for that purpose. Details are set out in the Privacy Policy.
3.7 No legal texts: Lumeya does not create legal texts (legal notice, privacy policy, terms and conditions) for customer sites and provides no legal advice. Lumeya displays notes and placeholders; the customer provides their own legal texts.
3.8 Further development: Lumeya may further develop services and change functions if there is an objective reason for doing so (e.g. security, technical development, statutory requirements) and the core service owed under the contract (creation, hosting, contact form, account with overview) is retained. For consumers, section 27 Consumer Warranty Act (Verbrauchergewährleistungsgesetz, VGG) applies: changes that go beyond maintaining conformity with the contract are made only for a valid reason, at no additional cost and with clear prior information; if a change significantly impairs access or usability, the consumer may terminate the contract free of charge within 30 days of the change.
4. Beta phase
4.1 Lumeya is in a beta phase. During the beta phase, use is free of charge; no payment data is collected. Upon registration, each account receives free beta access (one website with the services of the Start plan, including 2 new builds by Lumeya per month; a new build is when Lumeya regenerates the website from the customer's information or rebuilds it completely; the customer's own changes never count). In addition, during the beta phase the customer can order any offered plan as a beta subscription (section 2.2); a beta subscription costs €0. Functions may be incomplete, may change or may be discontinued; errors are possible; availability may be limited. We mark the beta status in the app.
4.2 We announce the end of the beta phase by email at least 4 weeks in advance. With the end of the beta phase, the free beta access and all beta subscriptions end, including those ordered after the announcement; no cancellation is required for this. A beta subscription never automatically converts into a paid subscription. Lumeya becomes subject to charge only through a new, express order under section 2.2; it establishes a new contract with its own billing month and, for consumers, its own withdrawal period. Without an order, the customer site is taken offline at the end of the beta phase; the account and content are retained and can be exported at any time (section 12).
4.3 Statutory warranty rights remain unaffected; the beta phase does not establish any exclusion of liability beyond section 13.
5. Prices and payment
5.1 After the beta phase, Lumeya offers subscriptions in three plans: Start €19, Growth €39, Locations €79 per month, in each case including value added tax, billed at the customer's choice monthly or annually (annual subscription: 10 monthly prices, i.e. €190, €390 or €790 per year, in advance). Included each month are the new builds by Lumeya stated on the pricing page (Start 2, Growth 5, Locations 5, in each case per website). The prices and scopes of service on the pricing page at the time of the order are decisive. If the pricing page mentions a custom domain or AI images, these services are included as soon as the respective function has been enabled on the platform (section 3.2, section 3.5).
5.2 Business customers in other EU member states provide their VAT identification number; the tax liability then passes to the recipient of the service (reverse charge) and the net amount is invoiced. For customers outside the EU, taxation is governed by the respective national law.
5.3 Depending on the chosen payment method, the subscription is billed monthly or annually in advance. Payment is made through a payment service provider, which we name in these Terms and in the Privacy Policy before paid subscriptions begin; Lumeya does not store payment card data. We provide invoices electronically.
5.4 Price changes apply only to future billing months. We announce them by email at least 8 weeks before they take effect and state the reason (e.g. increased costs for hosting, energy, personnel or statutory changes). Until they take effect, the customer may cancel with effect from the end of the current billing month; we point this out in the announcement. Within the first 12 months from the first paid conclusion we do not increase the price (price guarantee; with the founder condition under section 5.7, 24 months). For the same plan and the same payment method, an existing customer never pays more than a new customer; if we reduce the price, the reduction applies immediately.
5.5 In the event of late payment, after a reminder with a reasonable grace period we may temporarily take the customer site offline. The obligation to pay remains. Statutory default interest remains unaffected.
5.6 Annual subscription: The annual subscription can also be cancelled at any time with effect from the end of the current billing month. In the event of cancellation before the end of the paid year, we invoice the months used (each started month counts) at the agreed monthly price, up to a maximum of the annual price paid, and refund the remainder of the annual amount paid. No additional payment is ever due. Months of an agreed pause do not count as used. Without cancellation, the annual subscription renews for a further year at a time; even then it remains cancellable at any time with effect from the end of the month, with a pro rata refund under the same rules. Before each renewal we send a reminder by email.
5.7 Founder condition: Customers who were registered before the announcement of the end of the beta phase and built a website during the beta phase receive 20% off the respectively applicable list price of their plan for as long as their subscription continues without interruption; an agreed pause does not interrupt it. We grant the condition to the first 50 customers, at the latest until 31 December 2026; whichever occurs first applies. We show how many places have been allocated in the account under "Subscription", according to the actual status. In addition there are 24 months of price guarantee from the first paid conclusion (section 5.4) as well as the first paid month free of charge. The condition is not transferable.
6. Term and cancellation
6.1 The subscription runs for an indefinite period and can be cancelled by either party at any time with effect from the end of the current billing month (annual subscription: section 5.6). The free usage contract can be ended at any time by deleting the account.
6.2 Cancellation is possible in text form (email to office@luminantmind.com) or via the cancellation function in the account ("Subscription" area). In addition, the customer can cancel without logging in via the button Cancel contracts here (section 312k German Civil Code for consumers in Germany; we offer it to all customers). There the customer states the type of cancellation (for an extraordinary cancellation, with the reason), and the name and email address of the account; the contract number, a later termination date (if none is given, the earliest possible applies) and a further email address for the confirmation are optional. If the name and email address or the contract number match the account, the cancellation takes effect with the click on "Cancel now". If it cannot be assigned to a contract with certainty, we record it upon receipt and assign it; receipt is what counts for the end of the contract. We confirm every cancellation immediately on the page and additionally by email to the account's address (on request also to the further address), with the date and time of receipt and the time at which the contract ends; the email to the account's address contains a link with which the account holder can revoke a cancellation that they did not make themselves. If sending fails, we automatically try again.
6.3 The right to extraordinary cancellation for good cause remains unaffected. Good cause for Lumeya exists in particular if the customer breaches section 7 (content policy) despite a warning, if a breach is so serious that a warning cannot reasonably be expected, or if the customer is in arrears with two monthly amounts.
6.4 Consequences of cancellation: When the subscription ends, the customer site is taken offline. The account and content are retained under the free usage contract until the customer deletes their account; the customer can export them at any time (section 12), take out a subscription again or delete their account. If the customer deletes their account, we remove the account with all content, contract data and logs immediately; what remains without name and email address (in particular proof of the deletion) is set out in the Privacy Policy. Backup copies expire after 12 months at the latest. If Lumeya terminates the entire contract for good cause, we make the customer's content available as an export on request for a further 30 days and delete it afterwards. Statutory retention obligations (e.g. invoices, 7 years) remain unaffected.
6.5 Pause: Separately from cancellation, the customer can pause a paid subscription free of charge in the account under "Subscription" from the third paid month for up to three months within twelve months. The customer chooses whether the subscription continues or ends afterwards. If the customer selects "end afterwards", this counts as cancellation with effect from the end of the pause; we confirm it like a cancellation with the end date. Before the end of the pause we send a reminder by email.
6.6 Switching provider and transition period: The customer can switch to another provider at any time. The customer exports content and data themselves via the data export (section 12). The customer site published at the Lumeya address (https://web.lumeya.ai/s/…) can receive a permanent redirect (HTTP 301) to the new address for a transition period of 30 days; the redirect applies only to the Lumeya address and does not include query strings (e.g. form content). A custom domain of the customer remains with their registrar and is not redirected by Lumeya; the customer sets up DNS and redirects there themselves. Lumeya does not charge switching fees. The rules of the Data Act (Regulation (EU) 2023/2854, Chapter VI) on switching provider apply, including the prohibition of switching fees from 12 January 2027; Lumeya already complies with these principles today.
7. Customer obligations and content policy
7.1 Responsibility: The customer is responsible for all content of their customer site (texts, images, information, legal texts). The customer ensures that the content is lawful and that they hold all necessary rights.
7.2 Mandatory information: The customer maintains a complete legal notice and a privacy policy on their customer site (Austria: section 5 ECG, section 14 Austrian Commercial Code, Unternehmensgesetzbuch, UGB, section 63 Trade Act, Gewerbeordnung, GewO, section 25 Media Act, Mediengesetz, MedienG; Switzerland: Art. 3 para. 1 lit. s Federal Act against Unfair Competition, UWG, Art. 19 Federal Act on Data Protection, DSG; everywhere Art. 13 GDPR or DSG respectively). Lumeya may block publication for as long as these pages are empty.
7.3 Image rights: For uploaded images, the customer warrants that they hold the necessary rights of use and that persons depicted have consented (section 78 Austrian Copyright Act, Urheberrechtsgesetz, UrhG; section 22 German Art Copyright Act, Kunsturhebergesetz, KUG). The customer confirms this upon upload.
7.4 Prohibited content: The following are prohibited on customer sites and in the account:
- unlawful content, in particular violations of criminal law, youth protection law, copyright law, trade mark law, unfair competition law and personality rights;
- content that endangers minors, glorifies violence, spreads hatred or degrades people on the basis of protected characteristics;
- pornographic content;
- knowingly false or misleading statements, in particular about products, prices, qualifications, reviews or health;
- phishing, malware, spam, deception about one's own identity;
- content that violates sector-specific rules applicable to the customer (e.g. advertising restrictions for health professions, professional codes of conduct, price labelling law);
- use of the platform to monitor, harass or discriminate against third parties.
7.5 AI image generator: With the image generator, the customer must not generate people, faces, real public figures, third-party trade marks or logos, misleading "proof images" (e.g. alleged before-and-after photos, forged certificates) or content under section 7.4. These rules also implement the use restrictions of the model licence (CreativeML Open RAIL-M, Attachment A of the licence); these also apply to the customer.
7.6 Labelling of AI images: Lumeya labels AI-generated images in a machine-readable way in the image metadata (IPTC/XMP, entry "trainedAlgorithmicMedia"). In addition, the footer of a page of the customer site shows the notice "Some images were created with AI" if an AI image is visible on that page: an AI image in a section of the website or the AI cover image of a blog post (on the home page, in the blog overview and in the post, including "More posts"). Exception: If the customer selects an AI image from "My images" for a section in the editor, the home page currently does not recognise it as an AI image and does not show the notice there automatically; the customer then provides the notice themselves (e.g. in the text) if the image could be taken for real. The customer must not remove the labelling and must not pass off AI images as real photos (e.g. "our team", "our workshop").
7.7 Technical misuse: Attacks on the platform, circumvention of security measures, automated mass creation of accounts and use of the infrastructure for purposes outside the customer site are prohibited.
7.8 Indemnification: The customer indemnifies and holds Lumeya harmless from claims by third parties that are based on unlawful content or a culpable breach of these Terms, including reasonable costs of legal defence.
8. Rights to content and templates
8.1 The customer retains all rights to their content. The customer grants Lumeya the non-exclusive right, limited to the term of the contract, to store and reproduce the content, to process it technically (e.g. re-encode and scale images) and to make it publicly accessible, to the extent necessary for providing the services.
8.2 Templates, layouts, code and fonts of the platform remain with Lumeya or the respective rights holders. The customer may use the generated website for their purposes during the term of the contract. The customer may continue to use their own content from the data export (section 12) without restriction even after the end of the contract; templates, layouts and code of the platform are not part of the export.
8.3 AI images: Lumeya claims no rights to AI-generated images. The customer may use them within the scope of these Terms and the model licence. The customer acknowledges that purely AI-generated images generally enjoy no copyright protection and that third parties may generate similar images.
8.4 Lumeya names a customer site as a reference (name, screenshot, link) only with the customer's prior consent.
9. Moderation, notices and suspension (Digital Services Act)
9.1 Lumeya is a hosting service within the meaning of Regulation (EU) 2022/2065 (Digital Services Act, DSA) and the E-Commerce Act (ECG). Lumeya does not generally monitor customer sites and is not obliged to actively search for unlawful content (section 18 ECG, Art. 8 DSA).
9.2 Any person can report content that they consider unlawful via the report form at Report content (Art. 16 DSA); the procedure is also described there. Notices are handled by a human, promptly, carefully and without arbitrariness; we use automated tools at most for pre-sorting spam.
9.3 In the event of a breach of section 7 or of laws, Lumeya may respond proportionately at its reasonable discretion: request to make changes within a deadline, removal of individual content, temporary suspension of the customer site, suspension of the account, termination for good cause. In the case of obviously serious breaches (e.g. danger to persons, criminal content), Lumeya may act immediately.
9.4 Lumeya gives the customer a statement of reasons for every measure (Art. 17 DSA): which content is affected, which facts and which rule (law or clause of the Terms) it is based on, whether a notice or its own finding was the trigger, and how the customer can complain.
9.5 Complaint: The customer can object to any measure within 14 days by email to office@luminantmind.com. We will then review the decision again, carefully and not by automated means, and reply within 14 days. Legal recourse and the complaint to the Digital Services Coordinator (KommAustria) remain unaffected.
9.6 Point of contact: The point of contact for authorities and users under Art. 11 and 12 DSA is office@luminantmind.com (languages: German, English).
10. Availability, maintenance, backup
10.1 Lumeya aims for an availability of customer sites of 99% on a monthly average. Excluded are announced maintenance windows and disruptions outside our sphere of influence (e.g. network disruptions, attacks, force majeure). During the beta phase (section 4), no particular availability is guaranteed.
10.2 We announce maintenance work where possible 48 hours in advance in the app or by email and schedule it for low-traffic times.
10.3 Lumeya creates daily backup copies of customer data. We keep them on the server for 14 days, and an encrypted second copy on separate storage at Hetzner in the EU for a maximum of 12 months. The backup does not replace the customer's own data backup; the customer should use the data export regularly.
10.4 Lumeya may take security measures (e.g. blocking IP ranges, rate limiting) if this is necessary to protect the platform.
11. Data protection and data processing
11.1 How Lumeya processes the customer's personal data is set out in the Privacy Policy.
11.2 For data that Lumeya processes on behalf of the customer (in particular contact form enquiries, visitor statistics and content of the customer site), the parties conclude the Data Processing Agreement (DPA) under Art. 28 GDPR at registration. The DPA forms part of this contract and prevails in the event of conflicts on data protection matters.
11.3 The customer is the controller for the data of the visitors to their customer site and ensures lawfulness (in particular the information of visitors).
12. Data export
12.1 The customer can download the data of their account at any time in the settings under "My data" as a JSON file (including account and settings, subscription and credit history, projects with briefing and onboarding conversation, websites with all stored versions, content, legal texts, blog posts, check results and statistics, enquiries, image overview with descriptions, image orders, history of "Ask Lumeya", log and records of the emails sent to the customer; only security secrets such as the password hash are excluded) and additionally export their contact form enquiries as a CSV file. Images are listed in the export with their identifier and can be retrieved individually in the account. Details are set out in the Privacy Policy (section 17). The export is free of charge, without hindrance and possible in common, machine-readable formats (section 24 VGG; section 327p BGB).
12.2 The export is available for as long as the account exists; after termination by Lumeya for good cause, section 6.4 applies.
12.3 Statistics export: In addition to the JSON file, the customer can download the daily totals of the visitor statistics (events and pages) as a CSV file. The export is encoded with a UTF-8 BOM and contains the columns "Website ID", "Website address", "Day", "Type", "Event or page", "Count".
13. Warranty and liability
13.1 Warranty: For consumers, the Consumer Warranty Act (VGG) applies, including the obligation to provide updates during the term of the contract (section 7 VGG). For business customers, sections 922 et seq. of the Austrian Civil Code (Allgemeines bürgerliches Gesetzbuch, ABGB) apply; defects must be notified within a reasonable period after discovery (section 377 UGB).
13.2 Personal injury: Lumeya is liable without limitation for damage to life, body or health.
13.3 Intent and gross negligence: Lumeya is liable without limitation in cases of intent and gross negligence.
13.4 Slight negligence: For other damage caused by slight negligence, Lumeya is liable only if an essential contractual obligation has been breached (an obligation the fulfilment of which makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely), and then limited to the typically foreseeable damage. Otherwise, liability for slight negligence is excluded.
13.5 Business customers: Towards business customers, liability for lost profit, indirect damage and consequential damage is excluded, unless intent or gross negligence is present; liability is limited per case of damage to twelve times the monthly fee. Claims for damages by business customers must be asserted in court within 12 months of knowledge of the damage and the person causing it.
13.6 Lumeya is not liable for data loss to the extent that the customer has not used the data export at reasonable intervals and the damage could thereby have been avoided; sections 13.2 and 13.3 remain unaffected.
13.7 Lumeya is not liable for the customer's content or for legal texts that the customer provides themselves. Notes and text modules from Lumeya are not legal advice.
14. Right of withdrawal for consumers
14.1 Consumers have a 14-day right of withdrawal under the FAGG; for consumers in Germany, the right of withdrawal under sections 312g, 355 et seq. BGB applies with identical content. Details, exceptions and the model withdrawal form are set out in the Withdrawal Information.
14.2 In addition to by letter or email, the consumer can declare withdrawal via the withdrawal function: logged in, in the account under "Subscription", or without logging in at Withdraw from contract, in each case with "Withdraw from contract" and "Confirm withdrawal". The withdrawal is declared and effective upon the click on "Confirm withdrawal"; no further confirmation, for example via a link by email, is necessary. Without logging in, the consumer provides for identification the email address of their account and the contract number from the order confirmation. If the contract number is missing or does not match, we accept the declaration nevertheless; it is deemed submitted upon receipt, does not lapse, and we assign it to the contract as soon as the consumer logs in or replies to us or we can identify the contract with certainty. Immediately afterwards we confirm receipt on the page and by email to the account's address (durable medium), with the content of the declaration and the date and time of receipt.
14.3 If the consumer withdraws from a beta subscription, the ordered plan ends immediately, and the account again uses the free beta access (section 4.1), even if the plan had previously been cancelled, with its services (one website, 2 new builds by Lumeya per month); no amount is incurred. If the consumer withdraws from a paid subscription, it ends immediately, the new builds of the current month lapse and the customer site is taken offline; the account and content are retained. The consumer owes a proportionate amount for the time up to the withdrawal only as provided in the Withdrawal Information. The free beta access from registration is not an ordered subscription; the customer can end it at any time at no cost by deleting the account (section 6.1).
15. Changes to these Terms
15.1 We may change these Terms if this is objectively justified because of changed laws, case law, technical development, security requirements or an expansion of the offering and the change does not unreasonably disadvantage the customer. The core service and price are not changed thereby (section 3.8 and section 5.4 apply to these).
15.2 We announce changes by email at least 8 weeks before they take effect and highlight the changed points (Art. 14 para. 2 DSA). The customer can object until they take effect; we draw particular attention to this and to the consequences in the announcement (section 6 para. 1 no. 2 KSchG). If the customer does not object, the new Terms apply from the stated date. If the customer objects, the contract continues on the old terms and both parties can cancel in the ordinary manner.
16. Final provisions
16.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. Towards consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence (Art. 6 para. 2 Rome I Regulation). For consumers with habitual residence in Germany, the mandatory provisions of German consumer law therefore continue to apply in particular.
16.2 Towards business customers, Austrian law applies exclusively (excluding the UN Convention on Contracts for the International Sale of Goods); the exclusive place of jurisdiction for all disputes arising from and in connection with the contract is Vienna, Inner City (court with subject-matter jurisdiction). For actions by and against consumers, the statutory places of jurisdiction apply (section 14 KSchG; Art. 17 et seq. Regulation (EU) No 1215/2012); in particular, a consumer can sue at their place of residence and can be sued only there.
16.3 Alternative dispute resolution: Lumeya is neither obliged nor willing to participate in alternative dispute resolution proceedings before a consumer arbitration body. If a dispute arises that we cannot resolve directly, we will inform consumers about the competent dispute resolution body (section 19 para. 3 Alternative Dispute Resolution Act, Alternative-Streitbeilegung-Gesetz, AStG).
16.4 Accessibility: Information on the accessibility of the platform is set out in the Accessibility Statement.
16.5 Should a provision be invalid, the contract remains valid in all other respects.
Version: 27 September 2026
