Right of withdrawal

This is a translation for convenience. The German version is legally binding.

Who Does This Apply To?

The right of withdrawal (in Austria "Rücktrittsrecht", in Germany "Widerrufsrecht") applies to consumers who conclude the contract with Lumeya online (distance contract). Businesses have no statutory right of withdrawal.

• Austria: Sections 11 et seq. Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG). Lumeya is based in Vienna; the FAGG applies to all consumer contracts with Lumeya.
• Germany: For consumers habitually resident in Germany, the mandatory rules of Sections 312g, 355 et seq. German Civil Code (BGB) also apply (Art. 6 Rome I Regulation). This notice covers both; time limits and consequences are the same.
• Switzerland: Swiss law does not provide a statutory right of withdrawal for online contracts. Lumeya voluntarily grants consumers habitually resident in Switzerland the same right of withdrawal on the same terms.
• Beta subscription (free of charge): If you order a plan during the beta phase (beta subscription), the right of withdrawal applies equally. Because you then pay nothing, there is nothing to refund and no proportionate amount.
• Free beta access from registration: It is not an ordered subscription. You can end it at any time, without notice period and without cost, by deleting your account in the settings; the withdrawal function is not intended for this.

Withdrawal Notice

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Luminant Mind e.U., Johannagasse 29-35/14/5, 1050 Vienna, Austria, email: office@luminantmind.com) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but it is not mandatory.

You can also complete and submit an unequivocal statement electronically on our website at https://web.lumeya.ai/widerrufen or, when logged in, in your account under "Subscription" (buttons "Withdraw from contract" and "Confirm withdrawal"). If you make use of this option, we will promptly send you a confirmation of receipt of such a withdrawal by email to the address of your account.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your exercise of the right of withdrawal from this contract, in comparison with the full coverage of the contract.

Notice on Early Expiry of the Right of Withdrawal

In the case of a contract for services, the right of withdrawal expires early if we have fully performed the service and, before the performance began, you

1. expressly requested that we begin performing the service before the withdrawal period has expired, and
2. acknowledged that you will lose your right of withdrawal once we have fully performed the contract.

What this means for the Lumeya subscription: The subscription is a continuing contract; the service is "fully performed" only when the contract ends. You can therefore withdraw within the first 14 days. If you requested immediate commencement, you pay a proportionate amount for the days started up to the withdrawal, at least for one day (monthly price divided by the days of the billing month, multiplied by the days started; Section 16 FAGG, Section 357a BGB). No amount is payable for a beta subscription.

Withdrawal Function and Consequences in Detail

Where: When logged in, in your account under "Subscription" in the "Withdraw from contract" section (visible as long as withdrawal is possible), or without logging in on the page Withdraw from contract, which is linked in the footer of every page. There you enter your name, the email address of your account and your contract number (from the order confirmation), click "Withdraw from contract", check your details and click "Confirm withdrawal".

Confirmation: We display receipt immediately on the page. You also receive a confirmation by email to the address of your account containing the content of your statement (plan, time of conclusion of the contract, chosen method), your name (as you entered it in the form), the email address of the account, and the date and time of receipt (Vienna time). The form without login always responds identically and equally quickly, even if there is no account for the address entered; if there is no account for the address, we send the confirmation of receipt to the address entered. If sending fails, we automatically try again.

Effective upon the click: The withdrawal is declared with the click on "Confirm withdrawal". No further confirmation, for example via a link in an email, is necessary. Without login, your account's email address and your contract number serve for identification; when logged in, the login is sufficient. If the contract number is missing or does not match, we nevertheless accept your statement: it is deemed submitted upon receipt (decisive for the time limit), and we assign it to your contract as soon as you log in and confirm it under "Subscription", reply to our confirmation of receipt, or we identify your contract with certainty. Until then, your statement does not lapse; for the time limit, its receipt always counts. In this way, nobody who only knows your email address can end your subscription. If more than three unassigned statements per hour (or more than ten per day) are received for an account or address through the forms without login, we record further ones with the time of receipt but send no further email for them. We always send the confirmation of receipt of an effective withdrawal.

Time limit in the withdrawal function: The period begins with the conclusion of the subscription; a new conclusion after the end of a subscription or after the beta phase starts a new period, a plan change does not. We state the last day of the period in the order confirmation and in your account; the period ends at 24:00 (Vienna time). If the last day falls on a Saturday or Sunday, the function counts until the end of the following Monday; it does not take public holidays into account. If, according to our records, no withdrawal is possible (e.g. because the period has expired or you ordered as a business), we state the reason in the confirmation; if you believe that you are nevertheless entitled to the right of withdrawal, we will review your statement.

Consequences of withdrawing from a beta subscription: The ordered plan ends immediately. You use Lumeya again with the free beta access as before your order (one website, 2 rebuilds by Lumeya per month), even if you had previously cancelled the plan; your websites remain online. If the end of the beta phase has already been announced, the beta access ends with it as announced. No amount is payable.

Consequences of withdrawing from a paid subscription (possible only after the beta phase): The subscription ends immediately, the rebuilds of the current month lapse, and your websites are no longer publicly accessible. Your account and your data are retained; you can export them in the settings or delete the account. You owe a proportionate amount only if you requested immediate commencement (see above); we will refund any payment beyond that no later than 14 days after receipt of your withdrawal.

Withdrawal is different from cancellation: You can cancel at any time effective at the end of the current billing month, in your account or without logging in via Cancel contracts here (separate page, distinct from the withdrawal function).
